Guest Liability Waiver & Assumption of Risk

VIFO Insurance Template — For properties with pools, hot tubs, fire pits, waterfront access, or other recreational amenities

I,                      (“Guest”), on behalf of myself and all members of my party, hereby acknowledge and agree to the following in consideration of being permitted to use the property located at                      (“Property”):

1. Assumption of Risk

I understand and acknowledge that use of the Property and its amenities — including but not limited to the pool, hot tub, fire pit, outdoor spaces, waterfront access, and recreational equipment — involves inherent risks of injury, illness, death, and property damage. I voluntarily assume all such risks.

2. Pool and Aquatic Areas

I acknowledge that: (a) there is no lifeguard on duty; (b) all swimmers use aquatic amenities at their own risk; (c) children must be supervised by a responsible adult at all times; (d) I will enforce the no-diving rule in shallow areas; (e) alcohol use while swimming increases risk and I accept responsibility for my own decisions regarding alcohol.

3. Children and Minors

I represent that I am the parent, guardian, or supervising adult of all minors in my party. I accept full responsibility for the safety and conduct of all minors at the Property and its amenities.

4. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Property owner, their agents, employees, and successors (“Released Parties”) from any and all claims, demands, losses, and liability arising from my use of the Property or its amenities, including claims arising from the negligence of the Released Parties, to the extent permitted by applicable law.

5. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, losses, expenses (including attorneys’ fees), and damages arising from the acts or omissions of myself or members of my party during our stay.

6. Emergency Medical Authorization

In the event of a medical emergency involving any member of my party, I authorize emergency medical treatment and agree to assume financial responsibility for any medical expenses incurred.

7. Acknowledgment

I confirm that I have read and understand this waiver, that I am signing it voluntarily, and that I am                      years of age or older. I understand this is a legally binding document.
